Review of Taxi Industry Legislation

Passenger Transport Services Act 2011

In November 2011 Parliament passed a number of amendments to the Act. This was part of a broad package of legislation that will see the current Passenger Transport Act 1997 replaced by the new Passenger Transport Services Act 2011 from 1 July 2013.

The most significant change to the Act is that, once it commences, its title will be changed to the Taxi and Hire Vehicles Act 2008 and it will include regulation of restricted hire vehicle services. These services are currently known as limited passenger services and are regulated by the Passenger Transport Act.

As a result of the changes, further amendments to the Taxi Industry Regulations, the Luxury Hire Car Regulations and other regulations relevant to these industries will be required as well as new Regulations for Restricted Hire Vehicles.

The majority of these regulations will also commence on 1 July 2013. The invitation for comments on these regulations closed on 25 March 2013.

Taxi and Luxury Hire Car Industries Act 2008

The 'Taxi and Luxury Hire Car Industries Act 2008', the 'Taxi Industry Regulations 2008' and the 'Luxury Hire Car Industry Regulations 2008' took effect on 24 September 2008.

Operators, drivers and licence owners are encouraged to read the relevant legislation to ensure that they are aware of all of their responsibilities under the legislation.

The Act and Regulations were developed after a comprehensive review of the previous legislation undertaken over the course of 2006 and 2007. The Act provides for:

  • clear distinction between taxis and luxury hire cars;
  • improved arrangements for wheelchair-accessible taxis; and
  • the issue of owner/operator taxi icences.

2006-07 Review of Taxi Industry Legislation

Overview

Paper 1 provided background about the Review and an overview of what the Review was intended to cover.

The Taxi Industry Reference Group was formed to provide advice to DIER on behalf of the taxi industry on the issues covered in the Review.

Discussion Papers

The following nine discussion papers formed the basis of DIER's consultation with the industry and stakeholders. They were published over the period December 2005 to October 2006.

Meetings of the Taxi Industry Reference Group

Policy Proposals

Paper 11, published in March 2007, outlines DIER's draft policy proposals following the conclusion of the first stage of consultations.  A summary version was distributed to stakeholders.

Following further meetings with the Taxi Industry Reference Group and the receipt of submissions from stakeholders, Paper 12 was issued in July 2007.

Paper 12A, the final paper from the Review, was issued in August 2007 after a further meeting with the Reference Group to discuss concerns relating to the issuing of new taxi licences.
