Community (i.e not-for-profit, Charitable or Benevolent) Organisations - Temporary Exemptions for Small Passenger Vehicles

DIER received legal advice in 2007 indicating that some transport providers in the community transport sector, largely not-for-profit and charitable  organisations were technically carrying passengers  for reward using small passenger vehicles (that is, vehicles with less than 13 seats including the driver). This created a legal obligation on the provider to obtain  operator accreditation and on all drivers transporting passengers in these vehicles to apply for ancillary certificates. 

However, pending finalisation of the PTA Review as to the future regulation of this passenger transport sector, temporary exemptions exist for those community transport organisations operating small passenger vehicles.

The exemptions will remain until July 2012, by which time it is anticipated that new passenger transport legislation will be in place.
