The Nominal Insurer

The Nominal Insurer is a body established to ensure that injured workers are not disadvantaged where:

  • the employer does not hold a policy of workers compensation insurance
  • an employer cannot be located
  • the employer is bankrupt
  • the employer's insurer is insolvent or is unable to meet its liabilities under the policy

Where a claim is made but compensation can't be obtained from the employer, the claim is paid by the Nominal Insurer. The Nominal Insurer then attempts to recover the amount paid from the employer or insurer involved.

The Nominal Insurer is administered by a committee comprising members drawn from insurers, self insurers and government. It is funded by contributions from licensed insurers and from employers who are self-insurers.
